Minutes from Monterey Planning Board meeting Wednesday March 27, 2013

The meeting was opened at 7:10 p.m. The regular meeting of the Planning Board was rescheduled and posted for Wednesday March 27th due to a schedule conflict for co-chair Maggie Leonard. A copy of the posting is filed with the minutes.

Members present: Maggie Leonard, co-chair, Stephen Enoch, co-chair, Roger Tryon, and Barry Karson.

There was no business from the public.

The board read and approved the minutes from January 24, 2013.
The board read and approved the minutes from February 14, 2013.
The board read the minutes from March 14, 2013, and there was a question as to the correct number of lots on the Makuc plan. No one was certain so it was agreed to hold the minutes pending a review of the plan at the next Planning Board meeting on April 11, 2013.

The board reviewed the special permit application for Adams, Adams, & Walker single family dwelling at 8 Lakeside Ave. The property is in the Lakeshore District. The applicants seek to repair an existing deck on the lakeside of the house and to reconstruct and enlarge a deck on the east side of the house. The property is non-conforming as to size being 9,998 sq. ft., and the dwelling is non-conforming because it is in the setback on both the east and west side.

The board referred to section 5.0 of the Monterey Zoning Bylaws 2012 revised version on Non-conforming Uses and Structures. We discussed the plan for the screened porch on the east side and the increased encroachment into the side setback. The board discussed the abutters and the purpose of the setbacks in the zoning bylaws. We made a list of findings as follows:
  • The lot is in the Lakeshore District.
  • The lot is non-conforming as to size.
  • The dwelling is non-conforming because it is in the setback area on both the east and west side of the house.
  • The applicants seek to create and increase habitable square footage in the setback on the east side, which would bring them to 4’2” of the property line.
  • The change from deck to screened porch will increase the amount of impervious material (roofing) and result in increased run-off.
  • The proposed expansion on the east side of the house increases the non-conforming nature of the dwelling.
The board unanimously agreed that it would be detrimental to the neighborhood to allow expansion and new construction in the setback in the Lakeshore District, the most densely populated neighborhood in Monterey.

Leonard agreed that she would write the finding and email it around for editing prior to the ZBA hearing on April 3, 2013.
The board reviewed the list of suggestions that was generated at the solar bylaw public hearing held on March 14, 2013. A more in-depth review will take place at the next meeting.
